practice areas: Wrongful Termination
Employment contracts in Michigan which do not have a specific end date are presumed to be at-will. This means that either the employer or employee may terminate the employment relationship at any time for any reason, so long as it is not discriminatory under the law. However, parties may agree that termination may only occur for “just cause”, which is typically defined by the contract. Based on the terms of the contract, if either the employer or the employee terminates the relationship without “just cause” they could be in violation of the employment agreement, and liable for damages to the other party.
